This course examines the role of government attorneys and compares the issues and challenges faced by them at all levels of state and federal government in both civil and criminal law. Particular focus will be given to state attorneys general, the common law and constitutional bases for their role as a government's attorney, and the obligations of government counsel in both their advisory and litigation capacities. State attorneys general have recently transformed their role into influencers of national policy through litigation on a wide range of issues. This course will examine and critique the traditional functions of government counsel, the challenges of representing modern governments, and the emerging role that attorneys general play in shaping national legal policy.
